Terms of Service — fieldmonitor

1. Agreement

By accessing or using fieldmonitor ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including early access participants.

2. Service description

fieldmonitor is a market intelligence tool that monitors product pricing, seller activity and distribution across online channels and markets. The Service collects publicly available pricing data from URLs provided by you and presents it in a structured dashboard.

3. Account access

Access to fieldmonitor is currently by invitation only. You are responsible for keeping your login credentials confidential. You may not share your account or allow others to use your credentials. Notify us immediately if you suspect unauthorised access.

4. Acceptable use

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others. You may not:

Attempt to gain unauthorised access to any part of the Service or its infrastructure
Reverse engineer, copy or resell the Service or its outputs
Submit URLs that facilitate illegal activity
Use the Service to violate any applicable law or regulation

5. Data you provide

You retain ownership of the product and URL data you enter into the Service. By submitting data, you grant fieldmonitor a limited licence to process that data in order to deliver the Service to you. We do not sell or share your data with third parties except as described in our Privacy Policy.

6. Subscription, billing and refunds

Subscription plans and prices are shown on our website and are exclusive of VAT. Payments are processed by our payment service provider, Mollie B.V. We reserve the right to change pricing with reasonable notice; a price change will not affect your current billing period.

Refunds: if you change your mind, you may request a refund within 14 days of your purchase and we will refund the payment for that billing period. To request a refund, email us at mail@stefw.nl.

Cancellation: you can cancel at any time. Cancellation stops future renewals, and your access continues until the end of the current billing period.

7. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service is provided "as is" during the early access phase. We reserve the right to perform maintenance, apply updates or modify features with reasonable notice.

8. Limitation of liability

To the maximum extent permitted by law, fieldmonitor and its founders shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid in the three months preceding the claim.

9. Intellectual property

All software, design, algorithms and content that make up the Service are the property of fieldmonitor. Nothing in these terms grants you any rights to our intellectual property beyond the right to use the Service as described herein.

10. Termination

Either party may terminate access with 30 days written notice. We may suspend or terminate access immediately if you breach these terms or engage in conduct that we reasonably believe is harmful to the Service or other users.

11. Changes to these terms

We may update these terms from time to time. We will notify you by email of material changes. Continued use of the Service after notice constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
